In the following discussion, all images you upload and also those you create on the website are collectively referred to as your images. Images uploaded by other users and companies or created by them on the website are referred to as others' images. You retain copyright to your images unless they use others' images in them. When you share your images (make them visible to others), you permit the use of your images in others' images, either as backgrounds or as inclusions. You share copyright in others' images that use your images.
When you share your images, you license their use in others' images. When you use others' images, you agree to share copyright to your image with the users whose images you used.
Toonsket undertakes to share revenue with users for images that are shared. However, the revenue sharing feature is provided "AS-IS" and Toonsket is not liable for any failure to share revenue because of errors in the system. We also reserve the right to change the fractions of revenue shared without notice though we shall try our best to keep them as high as possible. When you set an additional price (a price over the default revenue share), you permit Toonsket to deduct a share of that additional price to meet our costs. The deducted percentage is also liable to change without notice though we will strive to keep the user's share of the additional price higher than the default revenue share.
You understand and agree that this service is provided "AS-IS" and that we assume no responsibility for the timeliness or incorrect delivery of user communications. We also provide no guarantees though we promise to attempt to store your information indefinitely. You agree that the service may be terminated at any time though we shall do our best to offer the service indefinitely. We have attempted and will continue to attempt to provide nothing but the highest quality of service and care, but we are at the moment not able to accept any liability for any damages arising out of your or anyone's use or misuse of this website.
We don't want to give information about you to your government or anyone else, but try not to do anything here that will set the law on our tail or make a court ask us to release customer information, because then all bets are off. In particular, do not upload any content that you do not own the copyright to. That would be plagiary and just wrong. Do no evil here and we'll be with you all the way.
We do not store your credit card number or any other information that could cause you monetary loss outside of the money you pay into Toonsket. All monetary transactions are performed through secure gateways provided by firms that look solid and that we trust (I know what you're thinking).
Please bear in mind that when we print cards and mail them for you, the cards will be seen, adjusted, quality checked, placed in an envelope, and mailed by employees of Toonsket and third party printing firms. This will continue to be the case until such time as we can automate the process.
You are responsible for maintaining the confidentiality of your password. Please notify us immediately of any unauthorized use or access of your account or password or any breach of security (write to admin@toonsket.com). Ensure you sign out of your account after using the website. We shall not be liable for any loss or damage arising out of your failure to comply with this section.
All information and content on this website are the sole responsibility of the person who posted the content. So, you are responsible for anything you upload or create and will have to deal with any lawsuits arising out of the same. In particular, when you reuse others' images in your images, you will be responsible for the contribution of your images alone and not for the contribution of others' images. Should your images be used in others' images, you will be responsible for any liability that arises because of your images and not for anything arising out of others' images.
You agree to help us keep the website safe for minors, young adults and adults and flag any graphics that are not suitable for viewing by minors. You agree not to hurt the sentiments of others through anything you post on the website.
You also agree to refrain from using words and language that would not be suitable for viewing by children. We reserve the right to bar any artwork from the website or prevent its being shared. We also reserve the right to bar users from the website.
When you share content, photos, art, graphics and other artifacts with other users, you license us to make them available in publicly accessible areas of the Toonsket website and to reproduce, distribute, adapt, publish, translate, promote and modify them.
When you communicate to us at Toonsket with suggestions, feedback, requests for features, ideas and comments, you acknowledge that your contributions do not contain proprietary or confidential information and that we are under no obligation to maintain the confidentiality of the same.
We may place limits on the number of images you may upload or on any other type of usage at any time without notice. We may also modify or discontinue, either temporarily or permanently any service offerings.
